Terms of Service

If you have absolutely any questions or concerns regarding our Terms of Service, please feel free to reach out! We're always here for you with whatever you need. ⸜(｡˃ ᵕ ˂ )⸝

Information

• Terms of Service and Prices are subject to change at any time. You are only subject to the ToS and prices agreed upon at the time of the transaction.

• DigiDessert reserves the right to refuse projects or requests based on content, subject, or other reasons.

• You (the Client) must be 18+ and legally able to commit to this agreement or have a legal guardian to make this agreement on your behalf.

Payment Information

• Payment is in USD. As a client, you may be responsible for paying any sales taxes/fees.

• The commission must be paid by the halfway mark of the commission. I will not continue the commission if it is not paid by then.

Deadlines & Delivery

• I always suggest reaching out before placing an order so that all information and requests can be decided upon beforehand.

• The delivery time depends on my workload, type, and queue. I will provide an estimated time for completion, and/or indicate if there is a delay in completing your commission.

• I will provide progress updates and seek the Client's (you) feedback voluntarily.

• The Client is entitled to a certain amount of revisions within the scope of the Commission. Any additional revisions beyond the agreed number will incur an extra charge. Please read the "Important" section under each service.

• Significant changes to the project, such as altering the concept or requesting major changes, may be subject to additional fees and time extensions.

Usage Policy

• The work usage depends on the commission, which will state whether the work can be used commercially or not. For merchandising, there may be an extra fee.

• All work that is used must credit DigiDessert.

• Once the commission is completed, Clients are not allowed to alter, modify, or edit my work without approval.

• DigiDessert reserves the right to post commissions. If you would like your commission to remain private, please inform me. A privacy fee may be required.

Refund Policy

• Refunds depend on the amount of work that has been completed and the time that has been spent on said work.

• If the Client requests cancellation of the commission within the first 24 hours and the work has not been started, a full refund will be provided.

• If the Client requests cancellation and I am already halfway done with the work, I may provide a 50% refund. The work cannot be used.

• If the Client requests cancellation and I am already more than halfway done with the work, I may be able to provide a 25% refund. The work can be used unless agreed upon.

• If I cannot complete work or there are delays for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, I will provide a partial refund only (50%).

Communication

• I define the scope of my work, features, price, deliverables, and other details for the project in a proposal in a format according to their discretion, which may include private messages through Twitter, VGen platform, Google document, or email. The details set forth by myself and the Client shall be agreed upon by the Client before work begins.

• Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.

• My response time may vary, but can take up to 24 hours to respond in order to provide better or more concrete updates.

• Communications through VGen, Discord, and Twitter are recommended.

Engagement

• By commissioning DigiDessert, you, as a Client, are agreeing to provide clear and complete requirements and expectations upfront, including reference materials or assets, before Work begins.

• Client grants Digi the non-exclusive rights to observe and replicate Client’s own character design and reference material for the use of the Work.

• Client warrants that they have the authority to enter this agreement, be the point of contact, and are solely responsible for decisions and approval during the process.

• Digi (I) warrants that I will not copy or heavily reference unauthorized materials.

• DigiDessert does NOT allow any usage of artificial intelligence (AI), any references using AI will be disregarded.

• The Client and Digi (myself) acknowledge that information and materials that are provided to either party (including but not limited to personal information, technical information, payment information, or sensitive information), or are incorporated into the deliverables, will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.
