General

♡ Terms of Service and Prices are subject to change at any time. You are only subject to the ToS and prices agreed upon at the time of the transaction.
♡ DigiDessert reserves the right to refuse projects or requests based on content, subject, or other reasons.
♡ You (the Client) must be 18+ and legally able to commit to this agreement or have a legal guardian to make this agreement on your behalf.

Payment Information

♡ Payment is in USD through VGen or other safe methods, such as Paypal, if needed.
As a client, you may be responsible for paying any sales taxes/fees.
♡ Once the invoice is paid, your commission will be started. If the invoice is not paid within a specific amount of time, the commission will be canceled.
Deadlines & Delivery

We always suggest reaching out before placing an order so that all information and requests can be decided upon beforehand.
♡ The delivery time depends on the Artist's workload, type, and commission. Each Artist will provide an estimated time for completion, and/or indicate if there is a delay in completing your commission.
♡ The Artist's timeline usually depends on how quickly the Client responds. No rush at all, but it does affect how quickly the Artist gets things done!
♡ The Artist will provide progress updates and seek the Client's feedback voluntarily.
Usage Policy

♡ The work usage depends on the Artist, where they will state whether their work can be used commercially or not.
For merchandising, there may be an extra fee.
♡ All work that is used must credit their Artist.
♡ DigiDessert reserves the right to post our commissions. If you would like your commission to remain private, please inform us.
A privacy fee may be required.
Refund Policy
︶︶꒦꒷♡꒷꒦︶︶
Refunds depend on the amount of work that has been completed.
♡ If the Client requests cancellation of the commission within the first 24 hours and the work has not been started, a full refund will be provided.
♡ If the Client and Artist cannot come to an agreement on the commission, the Client may receive a full refund.
♡ If the Client requests cancellation and the Artist is already halfway done with the work, the Artist will provide a 50% refund.
♡ If the Client requests cancellation and the Artist is already more than halfway done with the work, the Artist will provide a 25% refund.
♡ If the Artist cannot complete work or there are delays for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund only (50%).
Communication

When commissioning different artists within DigiDessert, Digi, the Shop Owner, will relay all the necessary information between the Client and Artist. In certain cases, group chats will be made between Digi, the Artist, and the Client.
♡ Our Artists normally define their scope of work, features, price, deliverables, and other details for the project in a proposal in a format according to their discretion which may include private messages through Twitter, VGen platform, Google document, or email. The details set forth by the Artist and shall be agreed upon by the Client before work begins.
♡ Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
♡ The Artist's response time may vary, Digi will reply as soon as possible but can take up to 24 hours to respond, in order to provide better or more concrete updates.
♡ Communications through VGen, Discord, and Twitter are recommended.
Engagement

By commissioning DigiDessert, you, as a Client, are agreeing to provide clear and complete requirements and expectations upfront, including reference materials or assets before Work begins.
♡ Client grants the Artist the non-exclusive rights to observe and replicate Client’s own character design and reference material for the use of the Work.
♡ Client warrants that they have the authority to enter this agreement, be the point of contact, and are solely responsible for decisions and approval during the process.
♡ The Artist warrants that they will not copy or heavily reference unauthorized materials.
♡ DigiDessert does NOT allow any usage of artificial intelligence (AI), any references using AI will be disregarded.
♡ The Client and the Artist acknowledge that information and materials that are provided to either party (including but not limited to personal information, technical information, payment information, or sensitive information), or are incorporated into the deliverables, will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

【Requirements To Apply】
We take our commissions very seriously and ensure that we are following the correct laws and regulations to properly run our online shop. We are NOT a business, but we are a team. When working with DigiDessert, you are a part of the DigiDessert team and will be responsible for taking on clients a part of DigiDessert. Therefore, you must conduct yourself professionally and follow the shop protocols.
Must be 18 years or older to apply.
Must have the legal right to work in the United States as a freelancer.
Must be aware of and comply with your local laws and regulations governing freelance work in your area, as these can vary widely.

| How will DigiDessert market their team’s services? |

| As our team grows, we will have dedicated sections on our website and platforms for each team member. Each team member will be "serving" fun drinks, desserts, and goodies of their choice and clients will be able to order that to get the team member's services! |
| If the client is confused, they can contact our shop and Digi will communicate with the client to define the scope of work. After gathering all the details about the commission, Digi will recommend an artist from the DigiDessert shop and confirm with the client if they approve of the chosen artist. Once the artist is confirmed, Digi will communicate all the necessary information to the artist regarding the client's needs. Digi will then set up a private chat with the client and artist, acting as a third party to monitor the commission throughout. If there are any questions or concerns about the commission, Digi will be available to answer them along with the artist. Additionally, DigiDessert has a private Discord server for our team members to organize their work and speak among other team members. This server helps organize commissions but also sends frequent updates so that clients can get proper communication and updates. |
| Each team member will receive their own set of graphics and a DigiDessert uniform and design, all of which are covered by the DigiDessert team during our startup program. We plan on advertising through social media and platforms such as VGen, Bluesky, YouTube, Twitter, etc. |
| What is DigiDessert's plan if team members leave? |

| We have established an agreement that each team member must sign upon joining the DigiDessert team to protect the DigiDessert brand and the team members. The agreement includes a section specifying that we must be notified a certain number of days in advance if a team member plans to leave. When hiring, we seek individuals committed to long-term engagement with DigiDessert and shared growth. Nevertheless, we acknowledge that unforeseen circumstances may lead some members to depart, and that's okay. If a team member has to leave, we will prepare for their departure, make an announcement, and handle or refund any commissions relating to them. It is our priority to ensure that our clients are not financially impacted by a team member's departure and to make our team member's exit a positive experience. While we never want members to leave, we recognize that it can happen and we respect their decision! Whether or not we have a high demand for that service, we may need to hire someone else to fill the spot but it truly depends on what our clients want. |
